What this site is, and is not

1. Accepting these terms

These terms govern your use of Mediclarum (“the site”), run by the individual named in the Legal notice (“the operator”, “we”, “us”). By using the site you accept these terms. If you do not agree with them, please do not use the site.

2. Who runs the site

The site is run by a private individual, not by a company, pharmacy, healthcare provider or manufacturer. It is free, carries no advertising or sponsorship, and sells nothing.

3. What the site is

Mediclarum is a general information reference. It helps you find and read publicly available official information about medicines, supplements, peptides and blood tests — such as the text of product labels, register entries and regulators’ notices — and shows where each item comes from.

The information is general. It is not tailored to your health, history, other medicines or circumstances.

4. Not medical advice

Nothing on the site is medical, pharmaceutical or other professional advice, diagnosis or treatment, and nothing on it replaces them. Using the site does not create a doctor–patient or pharmacist–patient relationship.

Always read the leaflet in your pack and follow your doctor’s or pharmacist’s instructions. Never start, stop or change a medicine, or disregard or delay professional advice, because of something you read on the site.

In an emergency, call your local emergency number immediately (112 in the European Union, 911 in the United States).

5. Not a medical device, pharmacy or shop

The site is not intended to diagnose, prevent, monitor, predict, treat or alleviate any disease, and it is not a medical device. We do not sell, supply, recommend, prescribe or broker the purchase of medicines, supplements, peptides or any other goods.

Mentioning a product, brand, manufacturer or substance is not a recommendation, endorsement or advertisement. Information about the regulatory status of peptides and other substances is reference information, stated with its date, and is not legal advice.

6. The tools on the site

The tools — the blood-test reader, My medicines, the visit summary, the pack scanner, the calculators, the comparison and “the same medicine in other countries” — are for information only. They work with the data you enter, and their output depends on its accuracy.

Text recognition from photos and scans can make mistakes; check every number against the original document. The blood-test reader shows where a value sits in the range your own laboratory printed; it does not interpret results or make a diagnosis. No tool checks whether medicines can be taken together, whether they are suitable for you, or whether one product can replace another. The calculators are not validated for clinical use. Recall and shortage checks use public notices from the US FDA, may be incomplete or delayed, and do not cover products from other countries.

7. Accuracy, sources and translations

Content comes from third parties — regulators and public databases. It may be incomplete, out of date or wrong, and copying, processing and translating it can introduce errors. The site says whether content has been reviewed by a clinician; unless a page says so, it has not.

The official source is always authoritative. Where the site and an official label or register differ, the official source prevails. Where a translation and its original differ, the original prevails. We may correct, change or remove content at any time.

8. Who may use the site

The site is intended for adults. Minors should use it only with the involvement of a parent or guardian.

9. Acceptable use

Use the site lawfully. You may not: scrape or bulk-download content by automated means in a way that burdens the site or goes beyond ordinary browsing; attempt to disrupt, overload, probe or circumvent the site’s security; present the site’s content as professional advice, as an endorsement, or as affiliated with us; or use the site in breach of any law or of anyone’s rights.

10. Intellectual property

The site’s design, code, the text written for it, and the selection and arrangement of its content are protected. You may view and print them for personal, non-commercial use.

Third-party data (for example from the US FDA, the US National Institutes of Health and the Bulgarian Drug Agency) is used under its sources’ own terms. Trade names and trademarks belong to their owners and are used only to identify products; their use does not imply any affiliation, sponsorship or endorsement.

11. Links to other sites

The site links to external websites. We do not control and are not responsible for their content, availability or privacy practices.

12. Availability and changes

The site is provided free of charge, “as is” and “as available”. We may change, suspend or discontinue the site or any part of it at any time without notice. We do not guarantee that the site will be available without interruption, free of errors or free of viruses.

13. No warranties

To the fullest extent permitted by law, we give no warranties, express or implied, about the site or its content, including as to accuracy, completeness, timeliness, fitness for a particular purpose or non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, the operator is not liable for any loss or damage arising from the use of, or inability to use, the site, or from any decision or action taken on the basis of its content, including indirect, consequential or special loss, loss of profit or loss of data.

Because the site is free, to the fullest extent permitted by law the operator’s total liability to you is limited to EUR 50 (or its equivalent in your local currency).

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the applicable law, including liability for death or personal injury caused by negligence, for fraud, or for intentional misconduct or gross negligence, and nothing affects your mandatory rights as a consumer.

15. Indemnity

To the extent permitted by law, you agree to indemnify the operator against claims, losses and costs arising from your breach of these terms or your unlawful use of the site.

17. Changes to these terms

We may change these terms. The current version and its date are published on this page, and significant changes will be noted on the site. Continuing to use the site after a change means you accept the new terms.

18. Governing law and disputes

These terms are governed by the laws of the country in which the operator is resident, without depriving you, as a consumer, of the protection of the mandatory rules of the country in which you live. Disputes are subject to the courts of the country in which the operator is resident, except where you, as a consumer, are entitled to bring proceedings in the courts of the country in which you live. Before taking any action, please contact us — most questions can be resolved quickly.

19. General

If any provision is found invalid, the rest remain in effect, and the invalid provision applies to the fullest extent permitted. Not exercising a right is not a waiver of it. We may transfer our rights and obligations under these terms. These terms and the Privacy Policy are the entire agreement between you and us about the site. These terms are made in English and Bulgarian; to the extent permitted by law, the English text prevails if they differ.
